What is an amicable divorce?

What is included in an amicable divorce agreement?

In order to be approved by the court, a divorce by mutual consent requires the signing of an agreement that regulates:
Parental rights and residence of the children – which parent will exercise parental rights and where the children will live.

Contact arrangements – the days and periods when the non-custodial parent will be able to see the children.

Child support – the amount of monthly support determined.

Spousal support (if applicable) – if one spouse is entitled to financial support after the divorce.

Property relations – the distribution of community property acquired during the marriage.

Use of the family home – which spouse will stay in the home.

Surname – whether the spouse who changed their surname at marriage will keep it or restore their pre-marital name.

Procedure for divorce by mutual consent

The procedure goes through the following stages:
Preparation of documents:

  • Application for divorce by mutual consent.
  • Agreement between spouses.

Filing an application with the district court of the domicile of one of the spouses.

Hearing:

  • The court checks whether the divorce is sought voluntarily.
  • The presence of the spouses is mandatory.
  • If necessary, the court may request an opinion from the Social Assistance Directorate.

Court Decision:

  • The court confirms the agreement and orders a divorce.
  • The decision is not subject to appeal.

Amicable divorce fees

Basic fee: up to BGN 40 at the time of application.
Additional fees:

  • 2% on the value of the property shares.
  • 2% on three years’ worth of maintenance.
